Brendan Scott

Brendan is the principal and founder of Open Source Law, a legal practice based in Sydney. Brendan has over 15 years of experience in dealing with IT and communications legal issues. Brendan is a director and founding member of Open Source Industry Australia Limited. He donated his time to represent OSIA at Standards Australia in respect of the OOXML ISO process and has drafted a number of submissions to various government inquiries on behalf of OSIA. Brendan gave advice to the SFLC on Australian law issues in the drafting of GPL v3. Brendan is a past president of the New South Wales Society for Computers and the Law and a past editor of its journal. Brendan is on the editorial board of the Internet Law Bulletin and is a member of the FSFE Freedom Task Force.

Earlier this year I had a conversation along these lines: Client: "I've just spent a heap of time sorting out a new business venture with a couple of others. We've hammered out a partnership agreement and we'd just like you to have a look at it". Me: "Do you know that partnership means that you are personally liable for what the other partners do?" Client: "..." Because they had chosen the wrong structure, all the other "law talking" they had done had to be revisited. By putting off involving a lawyer they caused extra work for themselves and ultimately delayed their business plans. In this talk we try to outline what role a lawyer can play for developers and highlight some points in the growth of an open source business, or in the development of an open source application, where it might be appropriate to get a lawyer involved.
